Individuals who want to bring a claim to Employment Tribunal must first comply with the requirements of the Early Conciliation service. With very limited exceptions, Tribunals will not allow a claim to progress unless the individual can provide proof that they have taken the initial steps involved in Early Conciliation.

In Spring 2014, the Government introduced the scheme as a way of ending employee disputes before they progress to become claims at the Tribunal, and accompanied several other measures to decrease the demand of the Tribunal service. Importantly, the process is free.
