Professional negligence falls under the rules on negligence but applies specifically to a situation where someone has breached their duty when acting in a professional capacity – so for example, a solicitor, accountant, financial adviser, architect etc. A professional person is positioning themself as having more than average skills or abilities and as such owes various particular duties of care to their client. Professional negligence is deemed to have taken place when the professional has fallen below the standards expected of a reasonably competent professional in his or her field. The claimant generally needs to demonstrate that they have suffered loss as a consequence of the professional negligence.
