If an employee’s behaviour repeatedly does not reach the standards laid out in the employee handbook (e.g. through persistent lateness or absence) then clear procedures should be followed before dismissing the employee to avoid the possibility of being taken to employment tribunal. Although the behaviour in question may not be serious enough to constitute gross misconduct, by its repeated nature it could become detrimental to the business. It is recommended that expert advice is followed to dismiss an employee in these circumstances.
