The awards for a tribunal loss are huge. A former employee can win 2 years’ pay for unfair dismissal (make that 5 years’ pay if there is a whistleblowing element) with the highest recorded award currently sitting at €1.25m. Discrimination awards can be up to 4 years’ pay or even unlimited in amount in gender discrimination claims. And that doesn’t take solicitor and court fees into account.
Few, if any, small businesses can survive such penalties, let alone have the money to fight the case without cover.
