    New Employment Bill puts focus on rights during early months of a job

    The Employment Rights Bill, introduced by the Government last week, has been described as the biggest upgrade to rights at work for a generation — although many of the changes will be subject to consultations that will see implementation delayed for two years.

What's going to change under the Employment Rights Bill?

  • Sick pay changes

    All workers, regardless of usual earnings, are set to gain statutory sick pay from their first day of absence, rather than day four.

  • Restrictions around zero-hour contracts

    Zero hours and low hour workers, as well as agency workers, will have a right to be offered a guaranteed hours contract if they regularly work consistent hours.

  • Sexual harassment changes

    The bill will increase obligations under the sexual harassment duty to require employers to take all reasonable steps to prevent it from happening.

  • An end to ‘fire and rehire’ schemes

    The bill aims to put a stop to ‘fire and rehire’ schemes in most situations.

  • Changes to employee contracts

    Employers will be required to inform employees of their right to join a trade union alongside their contract.

  • A new Fair Work Agency

    The government is set to establish a new Single Enforcement Body called the ‘Fair Work Agency’. It will also be able to bring claims to employment tribunal on behalf of a worker.

  • Flexible working changes

    Employers will have to explain why it was reasonable to refuse a flexible working request.

  • New day-one rights

    Employees will have the right to claim unfair dismissal from their first day of work. As it stands, they currently have to wait for two years. Plus, staff will gain day-one rights to paternity leave and unpaid parental leave
