HGV driving hours

If any of your workers drive Heavy Goods Vehicles (HGVs) i.e. vehicles with a maximum permissible weight of more than 3.5 tonnes and they are driving in an EU country, then their hours will be subject to the requirements of EU Rules on driving hours. The main EU rules on HGV driving hours state that drivers should not drive more than:

  • Nine hours per day (this can be extended to 10 hours twice a week)
  • 56 hours in any single week
  • 90 hours in any two consecutive weeks
  • Also all driving undertaken within the EU must be recorded on a tachograph, a device fitted to the vehicle to record driving times, speeds and distances.

The EU rules also include several requirements on rest breaks. HGV drivers must take:

  • At least 11 hours rest every day - they can reduce this to nine hours rest three times in a week
  • An unbroken break of 45 hours every week - they can reduce this to 24 hours every other week
  • Their weekly rest after six days of working
  • A break or breaks which total at least 45 minutes after no more than 4.5 hours driving

There are a few very specific exemptions to the EU Rules on driving hours. If your drivers are working in the non-EU countries listed below, they will be subject to regulations known as the AETR rules (The European Agreement Concerning the Work of Crews of Vehicles Engaged in International Road Transport). Since September 2010 the AETR rules have been amended, so they now closely reflect the EU rules on HGV driving hours.

  • Albania, Andorra, Armenia, Azerbaijan, Belarus, Bosnia and Herzegovina, Croatia, Kazakhstan, Liechtenstein, Macedonia, Moldova, Russia, Serbia and Montenegro, Turkey, Turkmenistan, Ukraine, Uzbekistan
