Unfair dismissal is by far the most recognisable term when considering employment law and employment rights. Employers lose unfair dismissal claims because they are either unaware of, or don’t follow the correct legal procedures before dismissing an employee.

Under the Unfair Dismissal Acts, 1977-2015, you must have fair grounds for dismissing an employee. The law presumes that all dismissals are unfair and it is up to the employer to prove that there were substantial grounds for dismissing the employee.
