Long term sickness is a thorny issue. As an employer, whilst remaining sensitive to an employee’s health issues, from a commercial perspective, you need your employees to be fit to carry out their duties.

It is important to have a sickness policy in place and generally speaking it is advisable to treat sickness absence as a capability rather than a conduct issue.

There is an obligation on the employer to ensure that you behave fairly and reasonably and do not discriminate in cases of long term sickness.
